Insight from Nash Attorney Dan Rosen
Do you know what a Universal Rundle Long Diverter Stem with “D” Spline Broach is? No? Neither do I, but my plumber does. That’s why I count on him to fix my plumbing. When it comes to protecting my family’s health, I turn to another expert: my doctor (especially during this COVID pandemic.)
The same should go for your disability case. The road to winning benefits can be perplexing and difficult to navigate, which is why you need an expert guide—a disability attorney who knows and understands the Social Security’s complicated rules and procedures. Unfortunately, we see too many clients who have come to us after being denied disability benefits, because they pursued their case based on incorrect information. They relied on what a neighbor said to them about qualifying for Social Security disability benefits, or something they read on the web, or got from a Facebook post. Let me share an example with you. A client—we’ll just call her Susie to protect her identity—was disabled due to an accident. She applied for disability benefits. While she was waiting for a decision from the Social Security Administration she heard from her neighbor that part-time work would not affect her case. She took a job and was working 38 hours a week. The SSA ruled that she was involved in “Substantial Gainful Activity” because she was earning more than the SGA limits established by Social Security. They denied her claim. Susie learned the hard way that every case is different.
There is nothing wrong with becoming educated about the disability process. It can be a good thing. But bear in mind that not everything you read in an online Social Security Disability Insurance (SSDI) support group is true; Facebook posts can be misleading and often times are just plain wrong; and the specifics of the cases of friends and family may not match your situation. Not every case is the same. If it were as simple as reading about it on the internet, there wouldn’t be law schools, medical schools, or plumbing schools. There are nuances that make each situation unique. For disability cases it’s not just about how sick a person is or their number of ailments, but how it fits in with the law.
A key part of any client/expert interaction is listening—for both parties. If I had an illness, I would want to ask my doctor the right questions, but I would also want to listen closely to what the doctor had to say. Sometimes disability clients come to us with their cases all mapped out in their minds. But you wouldn’t walk into your doctor’s office and tell your doctor what to prescribe. When we consult with you, we absolutely want to know what you have to say about your situation and, at the same time, it is also critical that you hear what we have to say.
