Can You Trust AI for Your Disability Case?

Some people who are considering filing for Social Security disability benefits are turning to artificial intelligence tools like ChatGPT, Microsoft’s Pilot, or Google’s Gemini for guidance on how to handle their Social Security disability claim. “I get it,” says Nash Attorney Lawrence Mabes. “AI spits out quick answers and it’s low-cost or even free. But beware. When your family’s financial well-being and your health are on the line, putting your faith in AI is likely to do you more harm than good.”

“Here’s why. AI lacks nuance and understanding of individual, complex medical scenarios. AI cannot distinguish between two people with the same impairment, but who have vastly different limitations. Individualized medical evidence coupled with individualized vigorous advocacy is what wins disability cases. AI is not a substitute for experienced legal counsel.”

“Another serious problem has arisen from using AI for legal cases. It is what some are calling ‘Hallucinations’­—situations when AI creates fake legal cases and data. In 2025 there were 518 documented cases of where AI produced hallucinated content in U.S. courts. As a result, many of these cases were thrown out of court. In January 2025 the Illinois Supreme Court warned that AI could ‘jeopardize due process, equal protection, or access to justice.’”

“It also should be noted,” Mabes points out, “that information input into AI is not protected by attorney-client privilege, so your personal information is there on the net and could be accessed by almost anyone.”

“In the final analysis, ChatGPT or any other AI is just a conglomeration of generalized information from the internet.  Much of that information is incomplete or simply wrong. We do this every single day, and we have learned through experience that each disability case, including your disability case, is unique. You should not fully trust AI to handle your disability case, because it lacks what a live human attorney can provide, the understanding of your individual complex medical condition, nuanced legal judgment earned through years of experience, and empathy for your situation.”

“The bottom line is this: AI has its place, but not as your lawyer, especially when your disability benefits, your health, and your family’s financial well-being are all at stake.”
